By accessing or using TeleVisor's services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing our services.

These Terms of Service apply to all users of TeleVisor's platform, including administrators, agents, and end-users of customer-facing features.

2. Description of Service

TeleVisor provides a Telegram ad operations platform that includes:

Core Features

• AI Agent: Automated response generation with GPT-4 integration
• Omnichannel Support: Email, chat, social media, and phone integration
• Knowledge Hub: Self-service documentation and intelligent search
• Smart Tickets: Intelligent routing and prioritization
• Smart Reporting: Analytics and performance metrics
• Help Center: Customer-facing knowledge base

Service Levels

• Free Tier: Limited features for testing
• Starter: Basic automation (up to 1,000 conversations/month)
• Explorer: Advanced features (up to 5,000 conversations/month)
• Pro: Full platform access (up to 20,000 conversations/month)
• Enterprise: Custom solutions with dedicated support

Third-Party Integrations

We integrate with third-party services (Stripe, Auth0, Cloudflare, and others) which have their own terms of service. By using TeleVisor, you also agree to comply with these third-party terms.

3. User Accounts

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use
• Ensuring your account information is accurate and up-to-date

You must be at least 18 years old to create an account. By creating an account, you represent that you have the authority to bind your organization to these terms.

4. Acceptable Use Policy

You may NOT use our services for:

Prohibited Content

• Illegal activities or content
• Spam, phishing, or malware distribution
• Harassment, hate speech, or discrimination
• Intellectual property infringement
• Adult content or gambling services
• Cryptocurrency mining or blockchain operations

Prohibited Actions

• Reverse engineering or decompiling our software
• Automated scraping or data harvesting
• Reselling or sublicensing without authorization
• Circumventing security measures or rate limits
• Impersonating other users or entities
• Interfering with service availability

5. Payment Terms

Subscription Model

• Monthly or annual billing cycles
• Credit-based system for AI usage
• Automatic renewal unless cancelled
• Prices available in USD, EUR, and RUB

Payment Processing

• Stripe for credit card payments
• Bank transfer for Enterprise plans
• Invoices issued monthly

Refunds

• 30-day money-back guarantee (see Money Back Guarantee page)
• No refunds for partial months
• Unused credits expire at end of billing period

Late Payments

• 7-day grace period
• Service suspension after 14 days
• Account termination after 30 days

6. Intellectual Property

All intellectual property rights in the TeleVisor platform, including software, design, logos, and documentation, are owned by TeleVisor, Inc. or our licensors.

You retain ownership of all data and content you upload to our platform. By using our services, you grant us a limited license to use your content solely for the purpose of providing our services.

You may not copy, modify, distribute, sell, or lease any part of our services without our written permission.

7. Data and Privacy

Your use of our services is governed by our Privacy Policy, which explains how we collect, use, and protect your personal information.

8. Service Availability

We aim for 99.9% uptime but do not guarantee uninterrupted service. Scheduled maintenance will be announced in advance when possible.

We reserve the right to modify, suspend, or discontinue any part of our services at any time. We will provide reasonable notice before making significant changes.

9. Limitation of Liability

To the maximum extent permitted by law:

• Our total liability is limited to the amount you paid for our services in the previous 12 months
• We are not liable for indirect, incidental, special, or consequential damages
• We are not liable for any loss of data, profits, or business opportunities
• We provide our services "as is" without warranties of any kind

10. Indemnification

You agree to indemnify, defend, and hold harmless TeleVisor, Inc. and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from:

• Your use of our services
• Your violation of these terms
• Your violation of any third-party rights
• Content you upload or transmit through our services

11. Termination

Either party may terminate the agreement:

• You: May cancel your subscription at any time through your account settings
• We: May suspend or terminate your access for violation of these terms, non-payment, or at our discretion with reasonable notice

Upon termination, you will have 30 days to export your data. After this period, we may delete your data in accordance with our retention policies.

12. Changes to Terms

We may update these Terms of Service from time to time. For material changes, we will provide at least 30 days' notice via:

• Email notification
• Prominent notice in our platform
• Updated "Last modified" date

Your continued use of our services after the effective date constitutes acceptance of the updated terms.

13. Governing Law

These Terms of Service are governed by the laws of the State of California, United States, without regard to its conflict of law provisions.

Any disputes arising from these terms will be resolved exclusively in the courts of San Francisco County, California. You consent to the personal jurisdiction of these courts.
